Description of Services

Messaging Zone provides communication and marketing technology services including email messaging, SMS messaging, fax messaging, marketing automation tools, and messaging infrastructure integrations. The Company may modify or discontinue services at any time without prior notice.

Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use the services. By using Messaging Zone services, you represent and warrant that you have the legal authority to enter into this agreement and will comply with all applicable laws and regulations.

Acceptable Use

Users agree to use Messaging Zone services only for lawful purposes. Prohibited uses include sending unsolicited or unlawful communications, transmitting fraudulent or deceptive messages, distributing malware or malicious code, violating the rights of third parties, or engaging in harassment or illegal marketing practices. Messaging Zone reserves the right to suspend or terminate accounts engaged in prohibited activities.

Compliance with Messaging Laws

Users are solely responsible for ensuring compliance with all applicable laws and regulations governing messaging and marketing communications including but not limited to the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), Campaign Registry requirements for SMS messaging, the Junk Fax Prevention Act, and applicable international data protection laws. Users must obtain all required consents, opt-ins, and permissions before sending communications through Messaging Zone services.

User Accounts

To access certain services, users may be required to create an account. Users agree to provide accurate and complete information, maintain the security of login credentials, and notify Messaging Zone immediately of unauthorized account use.

Payments and Billing

Certain services may require payment of fees. Fees may be charged on a subscription or usage basis. Payments are non-refundable unless otherwise stated. Messaging Zone reserves the right to modify pricing with reasonable notice.

Intellectual Property

All website content, software, trademarks, logos, and service materials provided by Messaging Zone are the property of the Company or its licensors. Users may not copy, reproduce, distribute, resell, or reverse engineer Messaging Zone software without authorization.

Third-Party Services

Messaging Zone services may integrate with or link to third-party platforms. The Company does not control and is not responsible for third-party software, external websites, or partner services.

Limitation of Liability

To the fullest extent permitted by law, Messaging Zone shall not be liable for indirect, incidental, or consequential damages arising from use of the services, service interruptions, unauthorized access to accounts, or actions of third parties.

Service Availability

Messaging Zone strives to maintain reliable services but does not guarantee uninterrupted or error-free operation. Services may be temporarily unavailable due to maintenance, upgrades, or network disruptions.

Termination

Messaging Zone may suspend or terminate access to services if a user violates these Terms, engages in unlawful activity, or fails to pay required fees.

Indemnification

Users agree to indemnify and hold harmless Messaging Zone from any claims or liabilities resulting from misuse of the services or violation of these Terms.

Changes to Terms

Messaging Zone may update these Terms periodically. Continued use of services after updates constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by the laws of the State of Florida.
